TRADE PRICE LIST EFFECTIVE FROM 2ND OCTOBER 2011
THIS PRICE LIST REPLACES ALL PREVIOUS ISSUES
Suggested retail prices including and excluding VAT are shown in this price list with trade discounts.
Prices are those at the time of going to print and are subject to alteration WITHOUT NOTICE.
ADDITIONAL DISCOUNTS ARE AVAILABLE FOR LARGER QUANTITIES WHICH ARE NEGOTIABLE. PLEASE CONTACT LUTON DIRECT FOR YOUR BULK REQUIREMENTS.
TERMS AND CONDITIONS
1) The acceptance of any order is on the understanding that the purchaser agrees to the terms of business hereon.
2) Prices are subject to Alteration without notice, which we cannot undertake to advise - in the case of reduction in price, customers may rely on obtaining the benefit. VAT will be charged at the appropriate rates.
3) Orders and instructions etc, received by telephone are accepted only at senders risk and should always be confirmed in writing.
Orders of less than £50 nett value will receive a flat rate discount of 15%.
Orders under £20 will be charged at full retail prices plus VAT, No orders under £10 will be accepted.
(a) Special ordered products requested by the customer to be ordered on their behalf are non-cancellable and non-returnable, plus a deposit of 50% will be required with the order.
4) CARRIAGE TERMS:
(a) UK MAINLAND ONLY
Carriage is chargeable on all orders of less than £200 Nett value excluding VAT.
All orders over £200 Nett value are carriage free, except where requested to be sent direct to their customers address, these are chargeable.
NB: The following items are excluded from our standard carriage terms, Fridges/Freezers, Origo Cookers, Large Anode orders, Anchors and chain that require to be shipped on pallets, these will be charged at cost.

Where goods are sent at the customers request by special services, these will be chargeable.
(d) DELIVERY
The company will not be responsible for late deliveries that are beyond our control.
(e) OWN DELIVERIES
Where goods are delivered by our own transport, these are normally carriage paid. While we
endeavour to maintain a regular delivery service when possible, weekly van deliveries are at
the companys discretion and we reserve the right to despatch orders when received rather
than hold them for van deliveries. Carriage will be charged at cost appropriately unless
written instructions are given by the customer and agreed in writing by ECS.
(f) All orders under £100. net will have carriage added if ECS are unable to deliver via
own TRANSPORT for whatever reason.
5) All goods are carefully packed before despatch. We cannot however, be held responsible for
damage in transit. Claims should therefore be made against the respective carrier immediately on
receipt of the goods.
6) Shortages must be notified in writing within three working days from receipt of goods
otherwise no claim can be entertained after that period has elapsed.
7) Payment terms are strictly nett monthly and payment must be made before the end of the month
following the month of supply.
The customer shall not be entitled on any grounds whatsoever, either wholly or in part, to withhold
Payment when it becomes due.
8) The time herein before-mentioned within which the customer is to pay for the said goods shall be
of the essence of this contract.
9) Title of these goods shall be and remain the property of the vendor, E.C. Smith & Sons (Marine
Factors) Ltd, until the full purchase price thereof shall be paid and in the case of non-payment it is
agreed that the vendor, E.C. Smith & Sons (Marine Factors) Ltd shall be entitled to re-possess the
goods and enter upon the customers premises for that purpose.
10) No goods can be accepted for return unless an authorisation number has been issued. Credit
notes cannot be processed without proof of purchase in the form of an invoice/delivery note
Number. A handling charge of 20% will be incurred for goods returned, which are not subject to a
manufacturers warranty. Note: Goods can not be returned 3 months after invoice date unless
either faulty or received in error.
11) We cannot be held responsible for errors in typing, illustrations, descriptive matter and technical
specification which are intended only as a reference.
12) ECS has a policy of continual improvement and reserve the right to amend or delete items
from the range without prior notice. All products in the ECS range are guaranteed for 12
months, subject to original manufacturers warranty terms and conditions.
13) ECS shall not be liable for consequential damages or loss to equipment or other property
or persons due to the use or installation of ECS products.
14) ECS shall not be liable for late deliveries due to lead times incurred from manufactures.
